INTRODUCTORY PROVISIONS

1.1 These Terms and Conditions (hereinafter referred to as "Terms and Conditions") of the company Foto here and now with its registered office at Újezd 71, Vodňany 38901, ID No.: 08090904 , registered in the Trade Register of the Municipal Office of Vodňany (hereinafter referred to as "Seller") regulate, in accordance with the provisions of § 1751 (1) of Act No. 89/2012 Coll, Civil Code (hereinafter referred to as the "Civil Code"), the mutual rights and obligations of the parties arising in connection with or on the basis of a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the Seller and another natural person (hereinafter referred to as the "Buyer"), including the Seller's online shop. The online shop is operated by the Seller on the website www.fototadyated.eu (hereinafter referred to as the "Website"), through the interface of the Website (hereinafter referred to as the "Shop Web Interface").

1.2 Provisions deviating from the terms and conditions may be agreed in the purchase contract. Deviating provisions in the Purchase Contract take precedence over the provisions of the Commercial Terms.

1.3 The provisions of the Terms and Conditions are an integral part of the Purchase Agreement. The Purchase Contract and the Terms and Conditions are drawn up in the Czech language. The Purchase Contract can be concluded in the Czech language.

1.4 The Seller may change or supplement the wording of the Terms and Conditions. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the Terms and Conditions.

1.5 The Buyer acknowledges that the sale of goods and provision of services in the Seller's online shop is intended only for persons aged 16 years and above.

WHO ARE WE AND WHY DO WE WANT YOUR PERSONAL DATA?

We are a company Foto here and now with place of business Újezd 71, Vodňany 38901, ID: 08090904. We are registered in the Trade Register of the Office competent under Section 71 (2) of the Municipal Office of Vodňany (hereinafter referred to as "Foto here and now" or "Administrator"). We operate an online shop at http://fototadyated.eu.

We provide various types of photo services, sell photographs, address you as our customers, advise you over the phone and for these purposes you provide us with certain personal data which we further process. We are therefore the data controller and are responsible for their protection and security and for ensuring that they are processed in accordance with the law (in particular the General Data Protection Regulation - GDPR).

Protecting your personal data is a priority for us. We have therefore taken a number of technical and organisational measures to protect and secure your personal data from loss, misuse or unauthorised access.

PROCESSING OF PERSONAL DATA IN CONNECTION WITH REGISTRATION AND ORDERING OF GOODS AND PHOTO SERVICES

We need your personal data for the conclusion of a purchase contract and a work contract for the purpose of processing orders and any complaints. You can order goods and services on our website www.fototadyated.eu without registering.

Registration is required to make full use of the photo order editor features (e.g. saving work-in-progress projects and uploaded photos) and my account features (e.g. copying a previous order).

You can cancel your registration at any time. Please note that if you cancel your account, all your saved photos, projects and order history will be automatically and irreversibly deleted. By cancelling your account you will lose all this data. Please also note here that we may still process your personal data for the purpose of fulfilling legal obligations under accounting and tax law, for the performance of a contract, e.g. in the event of a claim, or for legitimate interest until the expiry of limitation periods or for the recovery of debts.

THE SCOPE OF THE PERSONAL DATA REQUESTED IN THE CASE OF:

- orders for photo services or goods via our website: name, surname, address, phone and email. If you are ordering as a business, we also need your VAT number, business name and registered office.
